General Terms and Conditions of Sale

ARTICLE 1: PURPOSE OF THE CONDITIONS OF SALE

The present terms and conditions constitute the General Terms and Conditions of Sale for the services marketed by TOULOUSE BIKE TOUR, i.e. the organization of guided bike tours with a guide, following predefined routes, enabling the discovery of the city of Toulouse. Tours are available in French or English.

 

ARTICLE 2: GENERAL PROVISIONS

These General Terms and Conditions of Sale are reserved solely for consumers, as defined by law and jurisprudence, acting exclusively on their own behalf.

In accordance with articles L. 111-1 and L. 111-3 of the French Consumer Code, the essential characteristics and prices of the Goods and Services sold are available on the website http://www.toulousebiketour.com. The present Terms and Conditions of Sale apply to all sales of Goods and Services made by TOULOUSE BIKE TOUR.

The present General Terms and Conditions of Sale apply to all customers who participate in the services sold by TOULOUSE BIKE TOUR, even if the customer has not booked the service himself. By participating in the service sold, the customer is deemed to have accepted the present general conditions of sale.

The conditions specific to the sale of each tour (price, itinerary, etc.) as well as the General Terms and Conditions of Sale will be those in force on the http://www.toulousebiketour.com website on the date the reservation is confirmed. TOULOUSE BIKE TOUR reserves the right to modify all or part of these General Terms and Conditions of Sale at any time.

The customer declares that he/she has read these General Terms and Conditions of Sale before confirming the reservation. Validation of the reservation therefore implies unreserved acceptance of these General Terms and Conditions of Sale.

 

ARTICLE 3: RESERVATION

3.1 AVAILABILITY

Reservations for services marketed by Toulouse Bike Tour must be made at least 48 hours in advance. After this time, Toulouse Bike Tour cannot guarantee the reservation.

3.2 RESERVATION PROCEDURES

Reservations for services marketed by Toulouse Bike Tour may be made by telephone on +33 (0)5 31 61 91 95, by e-mail to contact@lepetitcyclo.com or directly online at http://www.toulousebiketour.com.  The order is considered validated upon receipt of payment of a deposit of 40% in our offices or the full amount online, and only when Toulouse Bike Tour confirms it by email.

For groups and companies, booking procedures are the same, i.e. by telephone on +33 (0)5 31 61 91 95, by e-mail to contact@lepetitcyclo.com or directly online at http://www.toulousebiketour.com. The order is considered validated on receipt of a 40% deposit, and only when Toulouse Bike Tour confirms it by email.

 

ARTICLE 4: PAYMENT

Receipt of a 40% deposit in our offices, or full payment online, confirms the reservation. The customer pays for the order by cash, cheque, credit card or bank transfer. The balance must be paid at the latest on the day of the service by cheque, cash or bank transfer.

 

ARTICLE 5 : MODIFICATION OR CANCELLATION BY THE CUSTOMER

5.1 CUSTOMER MODIFICATION

Any request by the customer to modify a booking will not incur any booking fees if neither the date of the tour, nor the name of the customer, nor the tour selected are modified, and if the request is made in the following circumstances: an increase in the number of participants, subject to availability.

Any request for modification from the customer under conditions other than those indicated will be considered as a cancellation followed by a new registration. All modifications or cancellations must be sent to us by e-mail or registered letter (postmarked).

 

5.2 CANCELLATION OF RESERVATION BY CUSTOMER

If the customer wishes to cancel his/her reservation, he/she must inform Toulouse Bike Tour by e-mail at contact@lepetitcyclo.com or by registered letter (postmarked) or via our website http://www.toulousebiketour.com by going to the "contact" tab. The date of receipt of the letter will be taken as the date of cancellation for the purpose of invoicing cancellation fees. You will find below the scale of cancellation fees.

Depending on the circumstances of your cancellation and the documents you provide, Toulouse Bike Tour will decide whether or not to accept a refund of the cancellation fee. Reimbursement of the reservation, less cancellation charges, will be made within 15 days of cancellation by bank transfer.

CANCELLATION FEE SCHEDULE :

  • In the event of cancellation more than 48 hours before the date and time of the reserved service, a cancellation fee equivalent to 5% of the total amount of the reservation will be retained.
  • In the event of cancellation within 48 hours of the date and time of the reserved service, a cancellation fee equivalent to 50% of the total amount of the reservation will be retained.
  • Cancellations made less than 24 hours prior to the date and time booked will not be accepted by Toulouse Bike Tour and will not be reimbursed. A cancellation fee equivalent to 100% of the total amount of the reservation will be retained.
  • Any partial or total interruption of the service due to the customer will not give rise to any reimbursement or compensation.

5.3 CANCELLATION OF SERVICE BY TOULOUSE BIKE TOUR

Toulouse Bike Tour reserves the right to cancel the service booked, if safety, the interests of the participants, or exceptional or unforeseen circumstances (weather, demonstrations and any event threatening the smooth running of the tour) so require.

In the event of cancellation by Toulouse Bike Tour, the latter undertakes to reimburse the customer in full. In the event of interruption of the service after it has begun, Toulouse Bike Tour undertakes to refund all or part of the sum paid, the amount of which will be assessed by Toulouse Bike Tour. Reimbursement will be made on the day of the service or by bank transfer no later than 15 days after cancellation.

 

ARTICLE 6: SERVICES

The content of the services is described on the http://www.toulousebiketour.com website. Toulouse Bike Tour provides the customer with a Bicycle and its equipment (helmet, locks) in order to carry out a predefined tour, with a guide. This equipment is regularly serviced and maintained by a team of professionals specializing in bicycle sales, maintenance and repair.

 

6.1 ACCESS TO SERVICES

Access to Toulouse Bike Tour services is open to minors aged 12 to 18 accompanied by an adult meeting the weight and height criteria below. The bike may be used by a person over 1.50 m tall and weighing less than 105 kg.

 

6.2 TOUR SCHEDULE

The meeting point is indicated on our website http://www.toulousebiketour.com and is systematically confirmed by e-mail or telephone. All participants must arrive at the meeting point at least ten minutes before the scheduled departure time. Any delay in arriving on time may result in cancellation of the tour, without entitlement to any reimbursement or compensation.

 

6.3 THE GUIDE-ACCOMPANIER

Before setting off, the tour leader sets out the safety rules, distributes safety equipment and explains how to use the equipment provided.

With the exception of personalized tours, the guide decides on the pace of the visit, breaks and itinerary, adapting them to the capacity of the participants. The guide-accompanier reserves the right to cancel the tour, or to modify the itinerary, if safety, the interests of the participants or an exceptional or unforeseen circumstance (weather, demonstrations or any event threatening the smooth running of the tour) so requires.

 

6.4 CUSTOMER PARTICIPATION CONDITIONS

The customer undertakes to use the bike in a reasonable and prudent manner. The customer declares that he/she is able to use a bicycle and that he/she is physically fit to do so. The customer undertakes to comply with the Highway Code and safety instructions issued by Toulouse Bike Tour prior to departure. The customer is not authorized to leave the group, unless exceptionally invited to do so by the guide. Customers are solely responsible for their actions on public roads.  Toulouse Bike Tour cannot be held responsible for any accident caused by the behavior of the customer or a third party. The customer is responsible for his or her own bike and equipment.

 

6.5 RETURNING THE BIKE

The customer undertakes to return the bicycle provided at the end of the tour. The bike must be returned to the tour departure point in the presence of the tour guide.

 

ARTICLE 7: LIABILITY - INSURANCE

Toulouse Bike Tour provides its customers with a bike that is in good working order, regularly serviced by a team of professionals and compliant with current regulations and safety requirements.  Toulouse Bike Tour is covered by third-party liability insurance.

At the time of the tour, the guide gives safety instructions, which the customer undertakes to follow.

The customer is solely responsible for the bike he/she uses. Toulouse Bike Tour cannot be held responsible for any damage sustained by the customer during the tour. The customer is solely responsible for any damage caused to third parties or other participants during the tour. Parents or legal guardians of minors taking part in the tour will be held responsible for any damage caused by them during the tour. The customer is hereby informed that he or she must have taken out personal liability insurance, covering the use of bicycles in particular, in order to guarantee against any damage occurring during the tour. Should the customer fail to take out such insurance, Toulouse Bike Tour cannot be held responsible for the absence of this personal guarantee. All fines and penalties that may be due as a result of the customer's use of the bicycle are the exclusive responsibility of the customer.

 

ARTICLE 8: LOSS, THEFT AND DAMAGE

From the moment the bike is made available to the customer until it is returned, the bike and its equipment are in the customer's custody. The customer shall be solely responsible for any loss, theft or damage to the bike and equipment provided.

In the event of loss, theft or deterioration of the bike and its equipment, the customer undertakes to compensate Toulouse Bike Tour by paying an indemnity valued at the maximum according to the nomenclature of bikes and spare parts in € including VAT.

 

ARTICLE 9: AUTHORISATION TO PUBLISH PHOTOGRAPHS

During the provision of services, photographs of customers may be taken.

The customer is informed and accepts that photographs in which they appear may be published by Toulouse Bike Tour on its website and other networks for promotional purposes.

Customers who do not wish photographs in which they appear to be published by Toulouse Bike Tour on its website or other networks must inform Toulouse Bike Tour before the start of the service or afterwards by sending an e-mail to the following address: contact@lepetitcyclo.com

 

ARTICLE 10: CONFLICT, JURISDICTION AND APPLICABLE LAW

These terms and conditions are governed, interpreted and applied in accordance with French law, the language of interpretation being French in the event of a dispute over the meaning of a term or provision of these terms and conditions. In the event that it is translated into one or more languages, only the French text will be deemed authentic in the event of a dispute. Subject to the provisions of public policy applicable in matters of jurisdiction, the courts of the registered office of Toulouse Bike Tour will have sole jurisdiction to hear any dispute relating to the performance or interpretation of these terms and conditions.
